חברת עודד דניאל בע"מ (להלן: "ביקום", "אנחנו" או "אנו"), המפעילה את מערכת ניהול וסידור משמרות עבודה Beecomm Shifts (להלן: "מערכת הניהול"), רואה חשיבות בשמירה על פרטיות לקוחותיה (להלן: "בית/בתי העסק"), מנהליהם ועובדיהם, ועושה מאמצים להגן ולשמור כיאות על המידע האישי של המשתמשים שלה ועל פרטיותם. השימוש במערכת הניהול ו/או בשירותים יהיה כפוף לתנאי השימוש המפורטים בכתובת ביקום ("תנאי השימוש") ולמדיניות הפרטיות זו. "אתה" או "משתמש/ים" פירושו כל אדם המשתמש במערכת הניהול ו/או בשירותים, לרבות מנהל בית עסק, עובד בית עסק ו/או אדם אחר הפועל מטעם בית עסק. המונחים אשר לא הוגדרו במפורש במסמך זה יפורשו בהתאם להגדרות שניתנו להם בתנאי השימוש או בחוקים הרלוונטיים.
אנחנו מכבדים את זכותך לפרטיות וחשוב לנו כי בכל עת יהיה בידיך כל המידע הדרוש כדי לקבל החלטות מושכלות הנוגעות למידע האישי שלך. מדיניות פרטיות זאת מפרטת את סוגי המידע האישי שאנו אוספים, והאופן בו אנו אוספים, משתמשים, מעבירים, ושומרים על מידע האישי על אודות משתמשים אשר נמסר לנו או אשר נאסף על ידינו במהלך השימוש במערכת ו/או בשירותים.

"מידע אישי" במדיניות פרטיות זאת הינו מידע הקשור לאדם מזוהה או ניתן לזיהוי, במישרין או בעקיפין, כגון שם, כתובת, מספר טלפון או כתובת אימייל.
דע, כי ביחס למידע אישי מסוים הנוגע לעובדי בית העסק, למנהליו או למי שפועל מטעמו, בית העסק קובע בדרך כלל אילו פרטים יוזנו למערכת ובאילו מטרות ייעשה בהם שימוש לצרכיו, כגון ניהול משתמשים, משמרות, נוכחות, משלוחים ותפעול. ביחס למידע זה, בית העסק עשוי להיחשב כבעל השליטה המאגר ו/או כגורם הקובע את מטרות ואופן העיבוד, ואילו ביקום עשויה לפעול, לפי העניין, כנותנת שירותים, כמחזיקה במידע ו/או כמעבדת מידע עבור בית העסק, כהגדרת מונחים אלה בחוק הגנת הפרטיות, התשמ"א – 1981 (להלן: "החוק"). לצד זאת, ביקום עשויה לעבד מידע אישי גם למטרותיה העצמאיות, כגון תפעול המערכת, אבטחת מידע, מניעת הונאה, תמיכה, בקרה, תיעוד ושיפור השירותים, הכל בהתאם לדין החל ולמדיניות פרטיות זו.
אנו אוספים מידע אישי מכלל המשתמשים במערכת הניהול ו/או בשירותים. המידע האישי שאנו אוספים כולל את המידע האישי שאתה מזין בעצמך למערכת הניהול כאשר אתה נרשם ו/או המידע האישי אשר בית העסק, מנהל מטעמו או משתמש מורשה אחר מזינים או מוסרים כאשר מבצעים רישום עבורך למערכת הניהול, ניהול חשבונך ו/או שימוש בשירותים. המידע האישי עשוי לכלול, לפי העניין, שם, כתובת אימייל, מספר טלפון, תמונה, שם בית העסק בו אתה עובד ותפקידך.
אנו נאסוף פרטים אודות שימושך במערכת הניהול ו/או בשירותים אשר עשויים לכלול פרטים לגבי נוכחות, כגון הזמנים שבהם נכנסת ויצאת ממערכת הניהול ופעילויות אחרות במערכת הניהול.
בנוסף למידע המפורט לעיל, במהלך שימושך במערכת הניהול ו/או בשירותים, מידע אישי וטכני מסוים עשוי להיאסף ולהישמר באופן אוטומטי,
לרבות מידע על מכשיר הקצה, מזהה מכשיר, מערכת ההפעלה, כתובת IP, היסטוריית הגלישה ושימוש במערכת הניהול, סוג הדפדפן,
ומידע טכני נוסף הנדרש לצורך תפעול, אבטחה, ניטור, תחזוקה ושיפור של מערכת הניהול ו/או השירותים.
בנוסף, אנו נאסוף את כל המידע האישי שאתה מוסר בעת יצירת קשר עמנו, מכל סיבה שהיא ונתעד את התקשרות שלנו אתך. ייתכן ונבקש ממך מידע אישי נוסף אם יהיה צורך בכך על מנת לספק לך את השירותים או שירותים נוספים שביקשת.
חלק מהשירותים המוצעים באמצעות מערכת הניהול הינם מבוססי מיקום, דוגמת שירותי משלוחים. בכפוף להסכמתך ולהרשאות המכשיר הרלוונטיות, אנו עשויים לאסוף ולעבד מידע על המיקום שלך לצורך אספקת שירותים אלה, אימות ביצוע משימות, תיעוד פעילות תפעולית, שיפור השירות ומניעת שימוש לא מורשה. אנו עשויים לשתף מידע זה עם בית העסק הרלוונטי ועם גורמים נוספים הפועלים מטעמו, לרבות לקוחותיו, ככל שהדבר נדרש לצורך מתן השירות הרלוונטי.

אנו עשויים לאסוף נתונים סטטיסטיים, מצרפיים ואנונימיים שהתקבלו והופקו כתוצאה מעיבוד מידע אישי ("נתונים סטטיסטיים"). זאת בכדי להתאים את מערכת הניהול ו/או השירותים לצרכים שונים ועל מנת לשפר ולייעל את מערכת הניהול ו/או השירותים ובכדי שנוכל לשקול שירותים ומוצרים חדשים ובכדי שנוכל להתאים שירותים ומוצרים קיימים לצרכיהם של המשתמשים. אנו עשויים להעביר את הנתונים הסטטיסטיים לצדדים שלישיים מורשים (כהגדרתו להלן), ללא הגבלה, בהתאם לתנאים המסחריים שנקבע ועל פי שיקול דעתנו הבלעדי. מידע סטטיסטי הינו אנונימי ולא נקשר אותו למידע אישי.

צדדים שלישיים מורשים אליהם יועבר מידע אישי עשויים להיות מצויים (כולם או חלקם) מחוץ לגבולות מדינת ישראל. ביקום תנקוט באמצעים סבירים ומקובלים כדי להבטיח רמה נאותה של הגנה למידע האישי אודותיך כמפורט במדיניות זו וכנדרש לפי הדין החל.
בהמשך לשימושך במערכת הניהול ו/או השירותים, ביקום רשאית לשתף את המידע האישי שלך עם בית העסק הרלוונטי, עם מנהליו, עובדיו המורשים ועם גורמים נוספים הפועלים מטעמו, ככל שהדבר נדרש לצורך ניהול יחסי העבודה, משמרות, נוכחות, משלוחים, שירות, תפעול, בקרה, אבטחה ומילוי הוראות בית העסק. מידע כאמור עשוי לכלול, לפי העניין, פרטי משתמש וחשבון, פרטי קשר, נתוני משמרות ונוכחות, פעולות שבוצעו במערכת, נתוני מיקום כאשר הופעלה פונקציה מבוססת מיקום, ומידע נוסף הקשור לשימושך במערכת. אנו עשויים לשתף את המידע האישי שלך עם גורמים נוספים בהוראת בית העסק, ככל שהדבר נדרש לצורך מתן השירות הרלוונטי ובהתאם לדין החל, כמו למשל שיתוף נתוני מיקום עם לקוחותיו של בית העסק לצורך מעקב אחר משלוחים.
אנו עשויים להעביר את מאגרי המידע שלנו המכילים מידע אישי לצד שלישי כלשהו ככל שהוא ירכוש את ביקום, את נכסיה או חלק מאלו ו/או במהלך מו"מ לגבי רכישת ביקום ו/או נכסיה ו/או חלק מאלה.
אנו נשתף פעולה עם רשויות אכיפת החוק או כל צו שיפוטי הדורש או המנחה אותנו לגלות את זהות, התנהגות או תוכן (דיגיטאלי) של משתמש אשר נחשד בפעולות הנחזות למנוגדות לדין או בפעולות מפרות חוק או אם נדרש לעשות כן בהתאם לדין החל, תקנה או צו בית משפט או רשות אכיפה כלשהם. כמו כן, אנו עשויים לשתף את המידע האישי שלך עם צדדים שלישיים אם אנו מאמינים בתום לב שגילוי המידע הינו נאות ונועד להגן על הזכויות, הרכוש או הבטיחות שלנו (לרבות אכיפת מדיניות הפרטיות ותנאי השימוש) או להגן על הזכויות, הרכוש או הבטיחות של צדדים שלישיים.
אנו נעביר את המידע האישי שלך לצדדים שלישיים רלוונטיים אם נגלה כי אילו מפעולותיך במערכת הניהול ו/או באמצעות השירותים מפרות את תנאי השימוש, ו/או מדיניות פרטיות זו ו/או נעשו לשם ביצוע תרמית מכל סוג שהוא ו/או אם נעמוד בפני נקיטת צעדים משפטיים נגדנו (פליליים או אזרחיים) בגין פעולות שביצעת במערכת הניהול ו/או באמצעות השירותים.
אנו נוקטים באמצעי אבטחה העומדים בסטנדרטים המסחריים המקובלים בתעשייה על מנת להגן על המידע האישי שנמסר לנו, החל במהלך העברתו, לאחר קבלת המידע האישי ובכל תקופת החזקתו ברשותנו. למרות האמור לעיל, העברת כל מידע באמצעות האינטרנט או כל אמצעי אלקטרוני אחר אינה בטוחה לחלוטין. בהתאם לכך, איננו יכולים להבטיח את בטיחות המלאה של מידע האישי המועבר אלינו, לרבות בטיחות מידע האישי שלך.
ביקום אינה אוספת במכוון מידע אישי אודות משתמשים שגילם מתחת לגיל 18. ככל שהנך מתחת לגיל 18 ו/או אינך רשאי לבצע פעולות משפטיות ללא אישור אפוטרופוס, אתה נדרש לקבל את הסכמתם הוריך או אפוטרופוס שלך לאיסוף המידע האישי שלך המתואר במדיניות הפרטיות. במידה ונחשפת לכך שמשתמש מתחת לגיל 18 נרשם למערכת הניהול ללא אישור כאמור, הנך מתבקש להודיע לנו על כך ללא דיחוי.

(hereinafter: "Beecomm", "we" or "us"), which operates the Beecomm Shifts work shift management and scheduling system (hereinafter: the "Management System"), attaches importance to protecting the privacy of its customers (hereinafter: the "Business" or the "Businesses"), their managers and their employees, and makes efforts to properly protect and safeguard the personal information of its users and their privacy. Use of the Management System and/or the Services shall be subject to the terms of use set out at Beecomm (the "Terms of Use") and to this Privacy Policy. "You" or "User"/"Users" means any person who uses the Management System and/or the Services, including a manager of a Business, an employee of a Business and/or any other person acting on behalf of a Business. Terms that are not expressly defined in this document shall be interpreted in accordance with the definitions given to them in the Terms of Use or in the relevant laws.
We respect your right to privacy, and it is important to us that you have at all times all the information required in order to make informed decisions regarding your personal information. This Privacy Policy sets out the types of personal information we collect, and the manner in which we collect, use, transfer and safeguard personal information about users that is provided to us or that is collected by us in the course of the use of the system and/or the Services.
This Privacy Policy is drafted in the masculine form for convenience only and refers to men and women alike.
You are under no legal obligation to provide us with personal information; the provision of personal information by you is done at your sole responsibility, of your own free will and with your consent. If you do not agree to provide the required personal information, in whole or in part, some or all of the applications of the Management System and/or the Services may not be available to you.
"Personal information" in this Privacy Policy means information relating to an identified or identifiable person, directly or indirectly, such as a name, address, telephone number or email address.
Please note that with respect to certain personal information concerning the employees of a Business, its managers or persons acting on its behalf, the Business generally determines which details will be entered into the system and for which purposes they will be used for its needs, such as the management of users, shifts, attendance, deliveries and operations. With respect to such information, the Business may be regarded as the controller of the database and/or as the party determining the purposes and the manner of the processing, whereas Beecomm may act, as applicable, as a service provider, as a holder of the information and/or as a processor of information on behalf of the Business, as those terms are defined in the Protection of Privacy Law, 5741 – 1981 (hereinafter: the "Law"). Alongside this, Beecomm may process personal information also for its own independent purposes, such as the operation of the system, information security, fraud prevention, support, control, documentation and improvement of the Services, all in accordance with applicable law and with this Privacy Policy.
We collect personal information from all users of the Management System and/or the Services. The personal information we collect includes the personal information you enter yourself into the Management System when you register and/or the personal information that the Business, a manager on its behalf or another authorized user enters or provides when carrying out registration on your behalf to the Management System, managing your account and/or using the Services. The personal information may include, as applicable, name, email address, telephone number, photograph, the name of the Business at which you work and your role.
We will collect details regarding your use of the Management System and/or the Services, which may include attendance details, such as the times at which you logged in to and out of the Management System and other activities within the Management System.
In addition to the information set out above, in the course of your use of the Management System and/or the Services, certain
personal and technical information may be collected and stored automatically, including information about the end device,
device identifier, operating system, IP address, browsing history and use of the Management System, browser type,
and additional technical information required for the operation, security, monitoring, maintenance and improvement of the
Management System and/or the Services.
In addition, we will collect all personal information that you provide when contacting us, for any reason whatsoever, and we will document our communications with you. We may request additional personal information from you if this is necessary in order to provide you with the Services or with additional services that you have requested.
Some of the services offered through the Management System are location based, such as delivery services. Subject to your consent and to the relevant device permissions, we may collect and process information regarding your location for the purposes of providing such services, verifying the performance of tasks, documenting operational activity, improving the service and preventing unauthorized use. We may share this information with the relevant Business and with additional parties acting on its behalf, including its customers, to the extent required for the provision of the relevant service.
We, our service providers and/or our business partners will use the personal information collected for the following purposes:
We may use your personal information for internal needs, for example, in order to assist in diagnosing operational problems, in order to improve the Management System and/or the Services and in order to adapt them to certain needs of ours and/or of the users.
We may collect statistical, aggregated and anonymous data received and derived as a result of the processing of personal information ("Statistical Data"). This is in order to adapt the Management System and/or the Services to various needs, in order to improve and streamline the Management System and/or the Services, in order that we may consider new services and products, and in order that we may adapt existing services and products to the needs of the users. We may transfer the Statistical Data to Authorized Third Parties (as defined below), without limitation, in accordance with the commercial terms that we shall determine and at our sole discretion. Statistical data is anonymous and we will not link it to personal information.
We may share information, including personal information, with authorized third parties only, and only to the extent required for the purposes set out in this policy, including, as applicable, with service providers, subcontractors, cloud infrastructure and storage providers, communications, messaging and mailing providers, providers of support, development, maintenance, information security, analytics and customer service, professional advisors, affiliated companies, as well as business partners relevant to the operation of the system or the Services on our behalf or on behalf of the Business (hereinafter: "Authorized Third Parties"), who may use the information in order to:
Authorized Third Parties to whom personal information is transferred may be located (in whole or in part) outside the borders of the State of Israel. Beecomm will take reasonable and customary measures in order to ensure an adequate level of protection for the personal information about you, as set out in this policy and as required under applicable law.
Further to your use of the Management System and/or the Services, Beecomm is entitled to share your personal information with the relevant Business, with its managers, its authorized employees and with additional parties acting on its behalf, to the extent required for the purposes of managing the employment relationship, shifts, attendance, deliveries, service, operations, control, security and compliance with the instructions of the Business. Such information may include, as applicable, user and account details, contact details, shift and attendance data, actions performed within the system, location data where a location based function was activated, and additional information relating to your use of the system. We may share your personal information with additional parties at the instruction of the Business, to the extent required for the provision of the relevant service and in accordance with applicable law, such as the sharing of location data with the customers of the Business for the purpose of tracking deliveries.
We may transfer our databases containing personal information to any third party to the extent that it acquires Beecomm, its assets or any part thereof, and/or in the course of negotiations regarding the acquisition of Beecomm and/or its assets and/or any part thereof.
We will cooperate with law enforcement authorities or with any judicial order requiring or directing us to disclose the identity, conduct or (digital) content of a user who is suspected of acts that appear to be contrary to law or of acts that constitute a breach of law, or if we are required to do so in accordance with applicable law, regulation or an order of any court or enforcement authority. Likewise, we may share your personal information with third parties if we believe in good faith that disclosure of the information is proper and is intended to protect our rights, property or safety (including the enforcement of the Privacy Policy and the Terms of Use) or to protect the rights, property or safety of third parties.
We will transfer your personal information to relevant third parties if we discover that any of your actions within the Management System and/or by means of the Services breach the Terms of Use and/or this Privacy Policy and/or were carried out for the purpose of committing fraud of any kind, and/or if we face the taking of legal proceedings against us (criminal or civil) in respect of actions that you carried out within the Management System and/or by means of the Services.
We employ security measures that meet the accepted commercial standards in the industry in order to protect the personal information provided to us, commencing during its transmission, following receipt of the personal information and throughout the entire period during which it is held by us. Notwithstanding the foregoing, the transmission of any information by means of the internet or by any other electronic means is not entirely secure. Accordingly, we cannot guarantee the complete security of the personal information transmitted to us, including the security of your personal information.
Beecomm does not knowingly collect personal information about users who are under the age of 18. To the extent that you are under the age of 18 and/or are not entitled to perform legal acts without the approval of a guardian, you are required to obtain the consent of your parents or your guardian to the collection of your personal information described in this Privacy Policy. If you become aware that a user under the age of 18 has registered to the Management System without such approval, you are requested to notify us thereof without delay.
You are entitled to review your personal information and/or, if following such review you find that the personal information held by us is not correct, complete, clear or up to date, to request to amend or correct inaccuracies or errors in the personal information, all in accordance with the provisions of the Law. In order to request to review your personal information or to correct or update it, please contact us at rnd@beecomm.com. We may request from you reasonable details or documents for the purpose of verifying your identity before we handle the request. To the extent that your personal information is processed by us on behalf of the relevant Business, we may refer you to the Business or handle your request in coordination with it, in accordance with the division of roles between us and with the provisions of the law.
We may use "cookies" ("cookies") – small text files that are sent to the browser on the computer you are using – in
order to provide you with a fast, efficient and personalized service and in order to save you the need to enter your personal
details upon each login to the system.
You are able to change your browser settings so that "cookies" are not collected on your computer or so that they are deleted.
We will retain personal information about you for such time as is required in order to fulfil the purposes of the use of the information set out in this Privacy Policy; to comply with our legal obligations; to resolve disputes; to enforce our agreements; or for a longer period as may be required under the provisions of applicable law. We may delete your personal information without notifying you thereof, so long as we consider that there is no need to retain it for the purposes set out above.
We reserve the right to send you notices relating to your use of the Management System and/or the Services, including service notices and administrative notices relating to your account or to your activity within the Management System, without offering you the option of cancelling their receipt. If you do not wish to receive marketing communications, you may remove yourself from the mailing lists in accordance with the removal instructions provided to you, or contact us; however, it is not possible to cancel the receipt of service and operational notices that are essential for the provision of the Services. If you do not wish to receive such notices either, you may cancel your account, subject to the attendant consequences for the continued use of the Services.
Our Privacy Policy may change from time to time. In the event that material changes are made to the Privacy Policy, a notice thereof will be published. Continued use of the system after the changes come into effect will be subject to the updated policy, and in cases in which the law requires the obtaining of renewed consent – we shall act to obtain it.
